By using any services provided by AWebCS Professional IT Web Consultancy Services, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions outlined in this document. These terms are subject to change at the company's discretion, and continued use of our services constitutes acceptance of any modifications.

1 Service Agreement & Acceptance
1.1 By purchasing, accessing, or using any services provided by AWebCS Professional IT Web Consultancy Services, you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and AWebCS.
1.2 AWebCS reserves the right to modify, update, or change these terms at any time without prior notice. Continued use of our services after any changes constitutes acceptance of the modified terms. It is your responsibility to review these terms periodically.
1.3 All services are provided "as is" and "as available" without warranties of any kind, either express or implied. AWebCS does not guarantee uninterrupted, error-free, or secure service. The company reserves the right to suspend, modify, or discontinue any service at any time without notice.
1.4 You must be at least 18 years old and have the legal capacity to enter into binding agreements to use our services. By using our services, you represent and warrant that you meet these requirements.
2 Payment Terms & Billing
2.1 All services must be paid for in advance according to the selected billing cycle (monthly, quarterly, annually, or multi-year). Payment is due immediately upon service purchase or renewal. Failure to pay may result in immediate service suspension or termination.
2.2 AWebCS reserves the right to change pricing at any time. Price changes will be communicated in advance, but continued use of services after price changes constitutes acceptance of new pricing. Existing customers may be subject to price increases upon renewal.
2.3 All fees are non-refundable except as explicitly stated in the Refund Policy section. Payment obligations are not subject to set-off, deduction, or counterclaim. You are responsible for all charges incurred on your account, including unauthorized charges if you fail to secure your account.
2.4 AWebCS may charge late fees, interest, or collection fees for overdue payments. The company reserves the right to suspend or terminate services for non-payment and may engage collection agencies or legal action to recover amounts owed.
3 Refund Policy - NO REFUND POLICY
3.1 AWebCS operates under a strict NO REFUND POLICY. All payments made for services are final and non-refundable. Once payment is processed, no refunds will be issued under any circumstances, including but not limited to: service dissatisfaction, change of mind, technical issues, service suspension, account termination, or any other reason.
3.2 This no refund policy applies to all services including but not limited to: hosting services, web development, app development, digital marketing, training programs, domain registrations, SSL certificates, and any other services provided by AWebCS.
3.3 By purchasing any service from AWebCS, you acknowledge and agree that you have read, understood, and accept this no refund policy. You waive any right to request refunds, chargebacks, or payment reversals.
3.4 AWebCS reserves the right to make exceptions to this policy at its sole discretion, but such exceptions are not guaranteed and do not create any precedent or obligation for future refunds. Any exceptions, if made, will be documented in writing.
4 Cancellation Policy
4.1 30-Day Cancellation Window: A 30-day cancellation window is available ONLY for services purchased with a 3-year commitment or longer. This cancellation window applies exclusively to 3-year, 4-year, or 5-year service plans. Monthly, quarterly, annual, 1-year, and 2-year plans are NOT eligible for the 30-day cancellation window.
4.2 Pro Rata Charges: For eligible 3+ year plans, if cancellation is requested within 30 days of purchase, a pro rata charge for the monthly basis plan will be deducted from any potential refund calculation. This means you will be charged for the number of days the service was used, calculated on a monthly basis, before any refund consideration.
4.3 Cancellation Process: To cancel an eligible service, you must submit a written cancellation request within 30 days of the original purchase date. Cancellation requests must be sent to [email protected] with your account details and reason for cancellation. Verbal cancellations or requests made after 30 days will not be honored.
4.4 No Cancellation After 30 Days: After the 30-day window expires, no cancellations will be accepted, and you are obligated to pay for the entire service period (3 years or longer) as agreed. Early termination after 30 days will not result in any refund or credit.
4.5 Service Suspension vs Cancellation: Service suspension or termination by AWebCS for policy violations, non-payment, or other reasons does not constitute cancellation and does not entitle you to any refund or credit.
5 Service Usage & Acceptable Use Policy
5.1 You agree to use AWebCS services only for lawful purposes and in accordance with these Terms and Conditions. You are responsible for all content, data, and activities associated with your account.
5.2 Prohibited activities include but are not limited to: illegal activities, spamming, phishing, malware distribution, copyright infringement, trademark violation, harassment, fraud, hacking, unauthorized access, resource abuse, and any activity that may harm AWebCS or its customers.
5.3 AWebCS reserves the right to suspend, terminate, or restrict your account immediately without notice if you violate this Acceptable Use Policy. No refunds will be provided for service termination due to policy violations.
5.4 You are responsible for maintaining the security of your account credentials, passwords, and access codes. AWebCS is not liable for any losses resulting from unauthorized access to your account due to your negligence.
6 Service Level & Uptime Guarantees
6.1 AWebCS strives to maintain high service availability but does not guarantee 100% uptime. Scheduled maintenance, upgrades, and unforeseen circumstances may cause service interruptions.
6.2 Service level agreements (SLAs), if any, are provided as targets and do not constitute guarantees. AWebCS is not liable for any losses, damages, or costs resulting from service interruptions, downtime, or performance issues.
6.3 AWebCS reserves the right to perform maintenance, updates, or modifications to services at any time, with or without notice. Service interruptions during maintenance do not entitle you to refunds or credits.
6.4 You acknowledge that internet-based services are subject to factors beyond AWebCS's control, including network issues, third-party services, and force majeure events. AWebCS is not responsible for service disruptions caused by such factors.
7 Intellectual Property & Content Ownership
7.1 All intellectual property, including but not limited to software, code, designs, documentation, trademarks, logos, and proprietary technology developed or provided by AWebCS, remains the exclusive property of AWebCS.
7.2 For custom development projects, AWebCS retains ownership of all code, frameworks, libraries, and tools developed during the project. You receive a license to use the deliverables for your intended purpose, but ownership remains with AWebCS unless explicitly transferred in writing.
7.3 You retain ownership of your content, data, and materials that you provide to AWebCS. However, by using our services, you grant AWebCS a license to use, store, process, and display your content as necessary to provide the services.
7.4 You are responsible for ensuring that all content you provide does not infringe on any third-party rights, including copyrights, trademarks, or privacy rights. AWebCS is not liable for any infringement claims arising from your content.
8 Service Termination & Suspension
8.1 AWebCS reserves the right to suspend, terminate, or restrict your access to services at any time, with or without cause, and with or without notice. Reasons for termination may include but are not limited to: policy violations, non-payment, illegal activities, abuse, or any other reason deemed appropriate.
8.2 Upon service termination, you must immediately cease using all services and remove all content, data, and materials from AWebCS systems. AWebCS may delete all your data, content, and backups without notice after termination.
8.3 Service termination does not relieve you of any payment obligations. You remain responsible for all fees and charges incurred up to the termination date, and for any remaining balance on multi-year commitments.
8.4 AWebCS is not obligated to provide data backups, content exports, or migration assistance upon termination. You are responsible for backing up your data regularly. AWebCS is not liable for any data loss upon termination.
9 Limitation of Liability & Disclaimers
9.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, AWEBCS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, REVENUE, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THE USE OR INABILITY TO USE OUR SERVICES.
9.2 AWebCS's total liability for any claims arising from or related to these Terms or our services shall not exceed the amount you paid to AWebCS in the 12 months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.
9.3 AWebCS provides services "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
9.4 AWebCS does not warrant that services will be uninterrupted, error-free, secure, or free from viruses or other harmful components. You assume all risks associated with the use of our services.
10 Dispute Resolution & Governing Law
10.1 Any disputes, claims, or controversies arising from or related to these Terms or our services shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act of India, or as otherwise agreed in writing.
10.2 These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts of Rudrapur, Uttarakhand, India.
10.3 You waive any right to participate in class action lawsuits or class-wide arbitration against AWebCS. All disputes must be resolved on an individual basis.
10.4 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
10.1 Any disputes arising from employment shall be resolved through binding arbitration in accordance with Indian Arbitration laws. Employees waive the right to a jury trial and agree to arbitration as the exclusive method of dispute resolution.
10.2 These terms shall be governed by the laws of India and the state of Uttarakhand. Any legal proceedings shall be conducted in courts of competent jurisdiction in Rudrapur, Uttarakhand.
10.3 Employees agree to pay all costs, expenses, and attorney fees incurred by AWebCS in enforcing these terms or defending against any claims brought by the employee.
